Equipment Rental Agreement
The information outlined below aligns with the agreement form that you will sign in-person when you rent an item from us.
Please take a moment to read through our rental agreement below.
Full payment is required with all reservations. Reservation cancellations must be made two working days prior to the first rental date to receive a full refund. Cancellations made after this date forfeit the full rental charge.
The original customer copy is required to process a refund. All credit/debit refunds will be processed through the Viking Union Finance Office. The VOR Staff does not have the authority to make direct refunds on credit card transactions.
Reserved equipment will be available on the first day of your rental date(s). Equipment is due by 1 PM of the return date.
For each delinquent day, 1.5 x the daily rental charge will be assessed. Exceptions for the late fees may be made at the discretion of the VOR Administration. Late fees for equipment returned within seven days of the due date shall not exceed half the retail price of the item. Renters who do not return equipment within seven days of the due date will be charged for replacement at current retail cost.
The renter is responsible for returning all equipment clean, dry, and in working condition. If you return equipment that is dirty, you may clean at the VOR facilities or pay $10.00 per item that we must clean.
At the time of pick-up, the renter is responsible for verifying the equipment is in good shape, serviceable condition, and ready for use as intended. The renter shall bear the entire risk of loss of damage to the equipment from any and every cause whatsoever, except damage caused by normal wear and tear, and shall be financially obligated to replace or repair the equipment as required by the VOR.
The renter agrees to take on full personal responsibility in knowledge and proper use of equipment. The equipment is to be used solely by the renter. Transference and/or use by anyone other than the primary renter is not permitted. The equipment shall be used in a careful and proper manner and as intended by the manufacturer. The renter shall comply with all applicable federal, state, and local laws and ordinances, and VOR rules and regulations, in any way relating to the possession, use, or maintenance of the equipment.
Renter understands and acknowledges the risks involved in renting equipment and will use the equipment for its intended purpose. The renter recognizes that the equipment and its use involves risk of injury and agrees to accept any and all risks associated with it, including but not limited to property damage or loss, minor bodily injury, severe bodily injury, and death. The renter understands that the equipment, no matter how well designed and maintained, cannot guarantee the prevention of bodily injury or death. The renter is voluntarily renting the equipment with the knowledge of the risks involved and hereby agrees to accept any and all inherent risks of property damage, bodily injury, or death.
In consideration of my use of the rental equipment and to the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless Western Washington University, its trustees, officers, directors, employees, agents, volunteers, and assigns from and against all claims arising out of or resulting from my use of the rental equipment. "Claim" as used in this agreement means any financial loss, claim, suit, action, damage, or expense, including but not limited to attorney's fees, attributable to bodily injury, sickness, disease or death, or injury to or destruction of tangible property including loss of use resulting therefrom. In addition, I hereby voluntarily hold harmless Western Washington University, its trustees, officers, directors, employees, agents, volunteers, and expressly agree to indemnify, defend, and hold harmless Western Washington University, its trustees, officers, directors, employees, agents, volunteers, and assigns for any claim arising out of or incident to my use of the rental equipment, unless caused by the sole negligence of Western Washington University.
